    Question about titled dirt bike

    Hope this is the correct place to post this. We have recently filed Chap 7.

    We have a dirt bike that we purchased on a Yamaha credit card. We intend to keep this as it's a kids bike, not worth much. The balance is small. HSBC is the holder of the cc account. The bike has a title with them listed as lien holder. I have been making the monthly payments on this account and have not missed one, but of course HSBC was included in the creditor matrix.

    Since they cut off my ability to pay online, which I have always done, I called the other day to ask where to mail the payment. The guy said the account is now being handled by Bass & Assoc. and to call them, which I haven't done. Aren't they a collection agency? I was surprised since I haven't missed a payment.

    Anyway, I'd like to continue to make payments, but I don't know if calling this Bass & Assoc. place is the way to go. I'm concerned about paying it off and how to get my clear title. And...I don't want them to come and get it.

    Any help is appreciated. Thanks.

    Reaffirm with HH and then, follow payment instructions.

      Yes Bass & Assoc. is a collections company. U need to reaffirm if it isnt to late, since you knew u were keeping the bike u should have already prepare to do so. Did u have an atty or did u file Pro Se.

        We have an attorney, and he was as surprised as I was to hear about the Bass deal. I would gladly reaffirm, as I've already done so on a vehicle, but I can't talk to anybody at HSBC, all they say is to call Bass. My attorney never received any reaffirm paperwork and neither did I.

        Not sure which way to turn. Maybe I should send a letter to the address of the lienholder on the title asking about it? Whaddaya think?

          If it was not a lot of money that is perhaps why the attorney was surprised. A lot of people reaffirm their debt without the formalty of reaffirmation agreements. Regarding the creditor not taking money out of your account, this is standard protocol. You have now have an opportunity to pay what the bike is worth as opposed to what you owe, there is room to negogiate in bankrupty.
