Well, we filed the papers today!!

My husband just left the courthouse after filing our chapter 7 papers. My gosh, I am so nervous now, hoping nothing is wrong with all of that paperwork. There was something wrong with the mailing matrix but I guess the clerk was able to fix that.

    Anyway, wish us luck.

It's such a relief to finally get filed! Now the waiting begins...keep posting here and we'll help keep you from going crazy (I hope!) until you know if all is well. We've all been through "filing nerves" even with a lawyer - it's tough but surviveable. Before you know it, it will be 341 meeting time - hang in there!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

    06/01/06 - Filed Ch 13
    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

Best of luck to you CIVA!! I was wondering which of us two would file first. Hang in there, I know it's hard to wonder and wait but know that I will be there right with you, well... as soon as I get up the nerve to bring in my paperwork that is. Congrats.

It is so reassuring to know that we have people supporting and rooting for us. I am so glad I found this forum. I probably would still be sitting back wondering what in the world I was going to do.

I have another question for y'all though. I do home childcare. I have an opportunity to take on another child. I am a little nervous about it though and here is why. My husband and I are far below our median as far as income so we did not have to take the means test. But when I did our monthly expenditures we have $36.00 left over at the end of the month. If I take on another child that will give us another 500.00 per month. I could really use the money but am afraid that it will push us into chapter 13. Our debt is 38,000 if that makes any difference in the calculations.

          Anyone have any advice?

Miss Puff....get your papers in. The sooner you file the sooner this will all be over with. At least we can go through it together.

My dh started a new job after the meeting with the trustee but before we were discharged. Nothing bad happened but the lawyer had to file that we moved w/a change of address. We were never asked what the new income was. I don't know what the law is.

I know you see the money dangling right now but maybe just wait a couple of months until you are discharged or at least wait until you have your 341.

Thanks so much. I was actually thinking the same thing. I just hate to turn any money down right now but, there is no sense in taking on extra work if I am going to have to turn around and give it to someone else.

              Thanks again.

Wait until after your 341 meeting to take on the extra child. That way if your trustee asks you during your meeting if your income has changed since you filed (ours did ask us that), you can truthfully say no. Don't want to take a chance on having to get switched to Ch 13 - depending on how your income is setting up against your expenses and debts, the extra $500/month could be enough to do that.

Just wait--tell the potential new client that you don't have any new opening for a few months. Better safe than sorry and wait for the discharge or well after the 341 meeting. Three months may seem like a long time and cause you to lose this client; however, it will make a big difference in the next 3 years of your life if your forced into a Ch 13.
