Why am I still getting all of these bills?

Hello again. I have another question. My husband and I filed ch 7 on August 2,2006. Our 341 is set for September 11. I am still receiving some medical bills from local hospitals. All of them are listed on the mailing matrix and also on schedule F. I am wondering why I am still getting them. I am calling the billing offices and notifying them of the bk just in case they havent received notice from the courthouse. Should I be doing that? I just dont want to end up having bills left on our credit because they werent notified or something. Thanks for any help.

You have retained an attorney at this point, it is safe to tell them but no real reason. My guess is you are getting the bills from an auto billing system. Sometimes it takes 2-3weeks to get out of the systems.

Nothing fishy yet. If you get statements next month I would call.

No, I havent retained an attorney. We are doing this Pro se. We have an easy no asset case....renting a house, 12 year old vehicle, nothing of any value. No credit card charges in years and years, mostly medical bills.

Yes, they gave that to me the same day we filed the papers. I also know who the trustee is and have already spoke with his office.

If that is the case, it is probably FraggleRock said. You are just still in their system. I received several calls after I filed as well. If you give them your case number, tell them you filed pro se and give the name of the Trustee, they should stop the calls. You can offer to send them a copy of the Schedule F if they claim they "never got it."

You need to be firm. Tell them you filed, here is the case number, don't call me again. Period. Tell them they were notified via the Schedule F and you are telling them again. If they call you again, they are in violation of the Stay.

What ever you do, check to make sure these medical bills are listed on the matrix as creditors........ and make sure they were notified in the mailings...

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

Send them a drop dead letter about the bankruptcy. My lawyer did that for me. You also file that letter with the courts.

Most creditors could care less if you filed bk. You have to take it upon yourself to inform them, as it wouldn't surprise me if the vast majority of official bankruptcy mailings they get go straight into the trash bin.

All of my creditors claimed 'Well we didn't get anything'. Yeah ok sure you didn't, you threw it away thats why you stupid @#%^#$&@^%$

As long as they are on your matrix, dont worry about it. We were discharged on jan 06 2006. I was still getting bills in March 06 . I would call and tell them, we were discharge and they would apoligize and said it was automatic billing and no one updated the system. At that point I said ok I will hold on the phone while you do update your system, and then you can confirm with me it was updated. As of that I have never seen a bill since.
I wouldn't bother acting on it until you are discharged. Save your self the headache.

                    good luck

Most people mail them to the wrong office. I worked in a pager store and people were always filing bankruptcy on us. They would mail the notice to the local office I worked at. Their bills didn't come to me. There was an office in OH that they went to. I'd always have to forward them onto the right office. Because of the mail system and how it all worked it could have easily been two weeks since it was mail before it was put into the system. We auto billed so it was more than possible to get a bill after someone mailed a notice.
