    question about a judgement

    hi everyone!i have a question i hope someone can answer.i got a letter today from an attorneys office who is a debt collector.they are representing mbna.im only behind a little over a month so i was a little surprised.they said that i have thirty days to pay 4700 dollars or they will get a judgement against me.i live in new york and own a house so im pretty scared.i am in the process of filing a chapter 7.i already signed all my paper work and paid the attorney fee.im just afraid that he will take his time going over all the paper work and go beyond the thirty days.anybody have any thoughts?

    Why do you get the feeling he will hold your papers beyond 30 days?? Did you ask when he was filing them? When we signed our papers, he told us that he was filing on that friday, come tro find out he actually filed that thrusday...not that it mattered. but he did tell us.
    Just ask...tell him there is a time senstive issue with am outstanding bill, and maybe he will move on it.
    Good thing is that the filing will protect you from further action on the collectors part.

      thanks for the quick reply.im getting a funny feeling that now that he is paid that he will take his time.maybe its just me.i have never been this stressed in my whole life.i think labor was easier then this!its hard because i really have no one to talk to.im to embarassed to tell anyone.i cant tell my parents because they would kill me.my sister is one of those miss high and mighty know it alls so thats out too.thank god for this board!i have three kids and its always get the phone but dont answer it.i cant wait to the the day when i can say go ahead and answer it.that in itself will be an awesome day!anyway back to the lawyer thing.it seems that at first he had all this time and answered all my questions.now i always feel rushed on the phone.im proably just worrying for nothing.

        This board has been great....you will be able to chat with others, and really get some helpful advise. I know what it is like about the phone thing.....I have 2 boys so I know how you feel.
        I would give it a few days, and then call to ask. Play stupid and ask so when is my 341 (creditors meeting). If they give you a date, rest assure, cause if there is a 341 date, that means your case is filed.
        If they don't have one for you, then ask if it was filed yet, and if not ask what the hold up is......you signed and paid, now it is up to them.

          You should definitely call your attny about this letter. Maybe even fax or send a copy for their records and info.

          Number 1,.......... It let's your attny know you are under the gun, legally speaking. He'll wanna file before your hauled into Court. That will stop any law suit pending against you dead in it's tracks.

          Number 2,.......... Your attny will probably want to add that Collector's name and address to your Creditor Matrix. Make sure they get notified of your filing same as all your other Creditors.
