    Please help me decide!

    I went to a 3rd lawyer consult today.A little background lawyer#1 wanted to do straight Chapter 13 he was kind of rude to us,lawyer#2 thought we could get out of it by getting a loan but no banks,agencies will lend us $50,000 w/out collateral.
    So we went to the 3rd guy today and maybe the third time is the charm.He was really infomative,the most thorough of them all.We have a problem with "failing the means test"which we knew.We pass it not counting dh's travel expenses but it has to be included in income because dh's company,to make it easier on themselves,just added it as a raise instead of expenses.So he said that's tougher to claim to the trustee.But he's willing to do a lot of investigating about this.He is on the board of national BK lawyers and he's going to email the question to BK lawyers around the country to see what they would do.
    I have to thank you all on this board,because of all my reading here I was able to ask some pointed questions.He told me he was so impressed with our knowledge and that usually when he hears people got their info from the internet it's usually misinformation,but that we had a lot of good info!lol

    Our debt is CC of $50,000
    He said he would try to go for a 7 and see where that goes,he said in our case it would be like angels lining up on the head of a pin just right lol we just have one of those hit or miss cases
    What would you do?

    Sounds like you've found a guy willing to do a little bit of work. Rather than take the easy way out.

    You may still wind up in a 13 anyway, but at least this guy/gal is gonna give you a shot at a Ch 7.

    Of the 3 you've met with, I'd go with #3. BUT,......... If you have more attnys in your area, maybe get a couple more Consults. You might get a consensus of opinions that way.

    Look on the Net for the Homepage of your BK Court. Find out who the Trustees are. Generally, Trustees are also BK attnys. If you haven't visited with a Trustee yet, make a Consult appt with one of them.
