    Total time from start to finish

    We are just about ready to file (after sending in payments here and there to the attorney....), but I have noticed that some of you have longer "case time" than others, and there are some out there who filed say in February and the case was closed in July....I guess I am just curious why some are quicker than others. Was it the amount of debt, type of debt, etc? We are filing on roughly $30K in credit cards, and will reaffirm our note for my husband's motorcycle (if we even have to, as we have never had a late payment). We own 2 vehicles (both 2001 - not worth alot I would say), free and clear....I am just wondering what could complicate our situation, etc.

    I guess I am just running around in circles - making myself a little bit sick thinking about the whole scenario.....

    timing simply varies by court.. if you r case is not complicated and no objections it will be about 30-45 days (from the date you file) until your 341 meeting and then another 60 day wait after that to see if any of your creditors object. If none object and the trustee finds nothing he wants to question, you should be discharged about 70-80 days after your 341 meeting. However, things could happen to cause a delay (backup of cases, getting lost in the shuffle, etc). Just be 100% honest and upfront and check PACER every so often to see what is happening with your case.

    I filed on 1/29/6 and was not discharged until 6/30/6 with my last day for objections by my creditors on 5/5/6. My case got lost in the shuffle due to the US Trustee not responding to something.. However, over and done with now and I could not be happier..

      Our case was a CH7/no asset. It was pretty straight forward. We filed 09/29/05, had our 341 on 10/31/05, yes I know Halloween..LOL, and was discharged on 01/06/06.
      I know there is alot of things to count into factor.....objections, how busy the courts are, if there are things the trustee want to check, there are all kinds of variables. There are some extreme cases, like poor Minymouth....she has been through it all, but is holding up with her head high!!

      For the most part it's all pretty much the same time frame.

        FIled on 10/12/2005....asset (income tax refund)....discharged on 02/16/2006......STILL WAITING FOR TRUSTEE TO GET OFF HIS (YOU KNOW WHAT) AND WRAP THIS UP!

            Yes psirasmom, it does weigh on your mind, but it does get better as each day passes. Just take it one day at a time. Find ways to keep yourself busy so you don't think about it. I'm a musician so I played as often as I could and it helped with stress. I would beat the living daylights out of my drums somedays. What a release! Working up a sweat did wonders for me.

            You WILL get through this, just like all of us did. Time will go by quicker than you think.
