    Nevermind, I misunderstood this but upon re-reading, I know understand!

        Oh no, I didn't think you weren't on my side. For some reason when I read your message I thought you were trying to tell me that my lawyer was going to make more money off a 13 because he would get payments from the Trustee during the 13 (even though he had already been paid in full).

        But I realize now you were saying that I paid him for representation throughout the 3 or 5 year plan and now he is not going to have represent me that long so he got paid for a service he didn't provide.

        The plot thickens though as I just looked at Pacer and he has already processed the conversion and a new 341 hearing date has been set, but he has not been paid his conversion fee, nor has he mentioned it.

        I wonder if he's worried now since the Trustee seem to be giving him the evil eye at the hearing?

          This is the same lawyer my brother hired about 3 years ago and suppose to be the best in our area. He doesn't want us in a 13 at all and that impresses me, but it also worries me a bit since we are over the income and if the trustee decides to tear apart our expenses then we have to go thru two 341 meetings I will be a basket case at that point! One thing I need to ask him though is how long do we have to wait to file a 13 if our 7 is dismissed, does anyone know?

          12/25/06: Last day for objections.... Dear Santa, can we have a bk discharge for Christmas please?

            I do not believe you will have to re-file. If the trustee tears your budget apart (as you say), he/she will motion to convert you from a 7 to a 13.

            No re-filing required.
