    Uh,Oh.I filled out the B22A Means Test form wrong...

    I filled the Means Test Form for Chapter 7 BK out wrong! Can I resubmit another corrected form?
    Duh,I just don't know how I did that.

      Also are you filing pro se or did you use an attorney???

      What actually did you fill out wrong and has it been filed yet?

        Is it possible to resubmit?

        I just thought it was my income that was required and I did not include anyone else in the house.
        Can I correct this?

          Yes I did file Pro Se and Yes I already filed....
          Either way all income is below the state median.

            Are the other household members giving you any money? Are you married to 1of the household members? As far as I know you would only have to list their income if you are claiming that you are supporting them. You would also have to list your spouses income for the median test. If you are below the median anyway you should be ok. The only downside is other posters have mentioned that the system usually picks on pro se filers since they feel you don't have as much legal expertise then an attorney.

              No husband or dependents but the three of us share household expenses.
              Should I resubmit the B22A form with their income and contributions included?

                If that's the case you shouldn't have to on the means test, but your schedules I & J are supposed to reflect exactly what you earn and your expenses. Legally your not supporting them and they aren't supporting you so I don't see a problem. I also never went to law school.

                  Accuracy and thoroughness are key in your paperwork. I would consider amending my forms ahead of time instead of waiting until your 341 hearing.

                    Yes I'm going to send in an amendment for the B22A and my current expenditures.Both have to reflect a three person household.

                      My brother is my roommate and I never put a thing about him or his income in my paperwork. I still only used the dollar amounts for the half of all the bills that I pay. It all worked out just fine without any questions or raised eyebrows from the trustee.

                        That's really good to know.I'm so confused wether to include people I live with.They say 'any entity that contributes to the household' and we all go in together on everything.So it's really hard to decide if I should resubmit the 'Means Test' and the 'current expenditures' to include other occupants or not.I don't want to screw this up and the BK laws meaning of 'household' is so lame.....
                        I guess I'll just go with the papers I filed and hope for the best.

                          I still don't think you have to include any of their income on the means test. At first no one was sure how this household rule would work but it seems that the household size is only being used for the median test. The more household members (spouse, kids, elderly parent, etc.) the higher your median level is. You can claim these family members as household members to get a higher allowed median level and higher expenses, but you must include what they contribute to the household. You must always include a spouses income for the median test even when not filing jointly unless you are legally separated. Our government, politicians and court system doesn't really recognize a family as a family unless there are marriage licenses or adoption papers. You can't claim feeding your partner as an expense and you can't count their income as your income. You do have to list your portion of the rent on schedule I which may leave you with more disposable income since this is shared.
