    Asset Cases, Chapter 7

    Hi,
    Just wondering if anyone has any experience with asset cases, and how long after discharge they normally close. We lost our tax return. Filed almost a year ago and case is still not closed. Sept. 9th will be the year mark date.

    Our attorney is vague, and says after proof of claims are issued it may take another six months. This seems crazy to me.

    We are in the same boat as you. Filed 12-30-06 and the trustee filed something (late July) signed by him and the US Trustee to distribute the income tax refund to two people only, one was the trustee. We are anxiously awaiting to close also!!!

      I saw where the trustee has already paid himself about almost half of the return, then we got a tiny, paltry amount of the refund. Nothing else has been done. I am so very weary of this whole ordeal. I didn't care if they gave us nothing of the return. Just want this whole thing behind us.

        Your lucky...... months is a short time................. I've been waiting 2 1/2 years now....................

        But mine is really unusual..........

        Hope they cut your "strings" soon for you............... I know you will be soo glad when its over..............

          Yes Minny, so glad if this ever ends. I truly have great admiration for you. I don't know how you've done it and been graceful about it for so long. I find myself some days just wanting yell at someone, the attorney, the trustee, the husband, whoever, but I know it won't change a thing.

            I'm waiting too

            We filed 10/12/05, asset, turned over portion of IRS refund in 05/06 and still waiting for closing...going on a year now.
            Bankruptcy History:
            Chapter 7 filed - 10/12/2005 - Asset
            Discharged - 02/16/2006
            Case Closed - 11/08/2007

                I just logged in to Pacer and saw a new entry. (Can't view the doc. for some reason.) It says "Trustees recommendation for claims". I assume it's a report stating how the money will be disbursed. Hopefully soon. I'm tired of taking nerve and sleep medications. I don't understand why so many sail through (don't get me wrong, I'm glad for those people), but others have this horrible year plus wait for their cases to close.

                  I question that myself bkadv. I almost want to go to the Trustee's office and start kicking some butts to get this done and over with.

                    I'd have to say it's been the longest, nervewracking year of my life. Sometimes I'd give anything to have sold everything we owned (or owed for), the house, the car and the clothes on our back rather than to have experienced the woes this has brought.

                      im in the same situation, waiting for the trustee to accept my offer (deal or no deal) so I can get the &$!! thing closed. It will be one year on Oct 5th and I for one will be glad to get it closed !! I just don't understand why they take so long to get things done.........when I met with the trustee in May he said be timely on my response. Well I replied with an offer two weeks later and no action, the first time I called (Jully) to see what the status is they couldnt find the documents requested in May, then two weeks later they called and said they found the documents, still no decision. I called last week and they said to call back maybe this week to check on the status. Feeling better now that I vented !!

                        Yeah, we do what they say and when they say to do it, but then we sit in limbo waiting for them. They got us by the (you know what).

                          Yeah, cause if you don't respond in a timely manner, or by the deadline they set, you're in trouble BIG TIME.

                          But they can take all the time in the world and simply say, "Sorry. Your case got shifted to the bottom of the pile for some reason." or "Sorry. The Trustee has been REALLY busy."

                            same boat here

                            Same Boat here filed 10/14/2005 discharged 02/06/2006. Assest case trustee has had money before 4/1/2006. Still waiting for closing. I thought Colorado was the only slow state. When I checked pacer last update was 6/12/2006 but it was a filing of a fee to be paid.
