    Question

    Now that my filling is done, I want to ask about something.

    NCO group called my brothers house a couple weeks back.

    the agent said tellsmy brother that he hadn't been able to contact me, so he just started calling names out of phone book. He proceeded to tell my brother that they are going to get a judgemnet against me, and that I better call.

    i called him, and he threatened sending the account to legal, and mentioned my checking account, all the tricks to try to get me to pay something.

    I was willing to let it slide, but the agent called me again the night I filed. I answered the phone, and he says

    How are we going to take care of this.

    I replied that I filled for chapter 7

    he is irrate now and asks for my att name and number.

    before i can give my case #, he says i thought you were going to try dmp.

    i told him it was not going to work, so had no choice but to file.

    he goes, so your just not going to pay, and he hangs up on me.

    What is the complaint procedure?

    Is it worth my time to pursue this issue?

    i have the mans name, extension, etc.

    Although the collector was definitely rude, unless he was overly abusive, used foul language, made false or misleading statements, refused to identify himself, or threatened to take an action that is not legal in your situation, he did not violate the Fair Debt Collections Practices Act http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm#808 so it's not possible to pursue legal action against the collection agency or the agent that called you.

    However, you can report the collections agency or company to the Better Business Bureau in your area.

      Don't sweat the small stuff! This guy was just pissed because his paycheck will be smaller this month - he'll get over it by conning someone else.

      I wouldn't waste my time or breath on NCO. Use your energy in a more positive manner, to your benefit.

      If you do some reading about NCO, you'll find they have had to pay millions of dollars in fines - more than once - doesn't slow them down at all.

      Filing a complaint will only cause YOU more aggravation - they could care less - just take comfort in knowing that in the end, even though he hung up on you, you got the last word
