    Bank of America

How long after you stopped paying did they, for anyone who dealt with them, throw you in in house collections? After that how long was it for a collection agency. They are getting more persistant now. I am waiting for a "preferental payment" I made to them to clear the 90 day period before filing so Chase and Discover dont complain!!! My minimum with them was so high is was well over $600 a month, and I need to wait out another month. At first I was getting recorded messages to call blah-blah-blah number but now real people are calling. Its been 60 days since my last payment and its already hit my credit report hard and interest rates across the board have started to go up.

We went 10 months from last payment to filing.

BoA, I have to say, was the worst to call. Multiple times every day thru the week. 8 am to 8-9 pm. Saturdays and Sundays were aweful. Double the number of calls each of those days as compared to a weekday. And that went on for weeks. Then suddenly, the phone went silent.

Calls started end of March, first of April. Ended sometime in May. We filed in September.

I thought sure they were turning us over to Collections or sold our debt, but they didn't. I learned later, when we checked our Credit, that's when BoA started pulling our Credit. Looking at who all we owed how much to and if we were paying anyone else.

I owe to BOA too, it's been more than 30 days and no calls so far, only citibank. I only have my cell phone and it's turned off all the time, if people really want to talk to me they leave a message, so in my case, phone calls won't be a problem.

I was placed in inhouse collections at 30 days past due, once they realized I was not going to pay them. At 90+ days or so, they handed my account off to an attorney in my state to proceed with a lawsuit, which I was served with about a week after I filed bankruptcy. They promptly withdrew it after a lovely conversation from our lawyer.

Is it preferential payment if you are paying the minimum due?? I'm probably within 90-100 days from filing, but I made a $800 payment to last month. I guess it will be my last.

We had one CC, the minimum was $500-$600/mo. One attny sent us a packet. Wanted all the papers filled out before the Consult. There was a question about who all we had paid $600+ in the last 90 days. I went thru and wrote down every Creditor that qualified.

The attny looked at the list. He marked thru our house and car payments. Said Secureds don't count. The others tho, the attny said the Trustee would go back to those Creditors to get the money. Nothing that would involve us. It would be between the Trustee and the Creditors, he said.

Another attny told us the Trustee going after the money would drag out our BK. The Preferential Payments might even make the Trustee more likely to look more closely at other things in our Filing. That attny told us to wait to file. Let the 90 days pass so we didn't have to declare any payments.

              check credit report

BOFA will continue checking your credit report and updating it as unpaid debt each month--leaving you with a high balance and the amount owed until you dispute it (that was my case at least). So...please check your credit reports. Don't rest feeling assured that your debts are gone simply because you filed bk and was discharged. Many will continue as a charge off.
