    I cashed payrl cks, 1st NSF, now chapt 11

    After a few months trying to collect NSF payroll checks that I cashed, the maker (a MN corp) filed chapt 11. Days prior to filing, maker issued me 4 post-dated checks to cover amt due, 2 dated prior to file, 2 after.

    *Can I pursue collection from the payee that negotiated their checks w/me?
    *Are these considered "priority" because they're payroll, yet I'm 3rd party?
    *Are the post-dated checks still considered pre-file debt?

    Your going to need to speak with an experienced BK attorney who knows Chapter 11 issues to answer those questions.

      Hi,

      Even though I could post responses to your questions, I think you'd be better off speaking to a BK attorney that is experienced at dealing with Chp 11's, do to all the technicalities involved with a Chp11. This site is primarily geared towards personal BK's: Chp7/13. So if you ever find yourself needing information about a Chp7 or Chp13 personal BK, please don't hesitate to post questions.
