    NetZero Collection Notice

    Okay.....I have had my 341 Chap 7 BK meeting (two weeks ago). I have listed all my creditors. Out of the blue Netzero comes at me with a collection notice for $20 bucks. They are not on my list of creditors, or people I owe money to and here is why.

    I cancelled their service two years ago! It would get quiet from them, and then all of a sudden, the billings would start back up from them. Then there would be another phone call from me telling them to knock it off. Which they would for a while then it would start back up yet again. In all the uproar that has been my life for the last 6 months they were the furthest thing from my mind. Now this.

    Anyone else had this kinda dealing with NetZero? I am aware that no one here can give legal advice, but I am wondering should I send a cease and desist letter, let my lawyer know about this (once she is back in town), or should I just ignore this completely?

    Send NetZero a letter telling them you filed and giving them your case number. In most US bk districts, if a creditor is left off the filing but if they had been included, the debt would have been discharged, then the forgotten creditor is automatically discharged as well.

    Ask your lawyer how your district handles forgotten creditors. Some local courts will make you amend your filing to include them. Most of the time adding a creditor doesn't cost much - about $30 - if it's before your 341 meeting.

    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      I managed to get in touch with my attorney today, and was advised that I can amend my petition by paying the fee. Which is $26.00. I'm kinda torn on this one as it would seem that I would only owe NetZero $20, but it's a zombie debt that I can't seem to make go away even two years later. With the BK I can hopefully get them out of my life for good.

      I dug around on the internet, and there is class action lawsuit being prepared against NetZero for illegal billing.

      Not quite sure which direction I want to take on this one.
      Not anyones advice to give I know either. It's definitely one I will have to think on.
