    mediation

i received a letter from a mediator outfit in Oklahoma stating that i was being sued by someone, they went on to say the good news is they werent the ones suing me but they could mediate a settlement for me. i had no idea what they were talking about, so i checked with the local county clerk office and sure enough, a small claims case was filed against me by some collection agency, i have not been served yet, as the case says it was sent to process servers, all my old debts, as far as i can recall are over ths statute of limitations so i am wondering if this mediation co is part of the collection agency or somehow working with them,a lawyer is the one suing me from another town, and i am wondering why he would try this knowing how old the debt is. the amount is for 2500 and i am in florida. has anyone else had this happen?

The mediation company is probably not working with them...my guess, the mediation company simply trolls the recent filings in the court and sends mailers to everyone that was sued for a debt owed in an attempt to drum up business. Just ignore the mediators, they are merely offering to settle the lawsuit for you.

Keep in mind...if you used to live in that state, they can get "good" service on you eventually (service by publication)...so simply burying your head in the sand may not be the best way to handle this as eventually they will get a judgment. If the debt is really beyond the statute of limitations, it may be worth it to you to file a Motion to Dismiss the claim based on the fact that the claim is outside the statute of limitations.
