    Judgement Summons

    Hello All
    I had made an arrangement with my creditors to try to avoid bankruptcy. In June I signed an agreement with an attorney for HSBC Bank for a debt I had in the amount of $3030. This amazed me because the original credit line on the car was only $300! But, I was tired of arguing the fact and agreed to make payments of $200 per month beginning in June of this year. I have made the monthly payments to the attorney since June (although 1 payment was sent out 3 days late due to surgery I had) and on Thursday of last week, I received a 'Summons" in the mail from the city court. It stated that I did not need to appear in person. I wrote a letter to the attorney who originally filed the judgement stating that I have made the agreed upon payments every month and I have my receipts to prove it. If they force a wage garnishment, then I will be forced to file bankruptcy. I have busted my hump trying to make payments on my debts and have worked 15 hours overtime every week to try and do it.
    Can they garnish my wages when I have been making the payments?? This just seems so unfair. Any help would be so appreciated!

    When you were three days late your agreement was breached. They do not have to reinstate it.

    Without more information on your total situation that is all the help I can offer.

      Ditto...

      This is a cautionary story to other members...BK is almost always easier than trying to work with creditors.

        thankyou all. But, the original agreement I made with the attorney working for the creditor was that payment was to be made no later than 5 business days after the 28th of the month (the agreed upon date). I mailed the late payment on the 1st (it is a local attorney) so they should have received it on the 2nd.
        Anyway, I mailed a certified letter to the attorney and havent heard anything further. I dont know if this is good or bad.
