    will CA/CC's go into my accounts?

    Hello All,

    I was thinking...I used to pay all my bills and credit cards online with my account info saved on the "payment page" of the creditor. Anyway, I haven't paid my credit cards since Mid May (we are hoping to file ch 13 in Aug) and my AMEX has been turned over to a CA. I am a little worried now that my accounts are going to 'collection agencies' that they will get my bank info and withdraw my funds! Can they do that? Should I change accounts?

    In my experience, best safe than sorry. Why not change banks, before the BK shows up on your credit report? CAs/Creditors would technically have to have a judgment to get at your accounts, but strange things do happen. Play the "cup is half-full" from your point of view and at least open a new account elsewhere.

      The issue with exempt funds is important. In many states 75% of wages are exempt even after they've been placed in a bank account. this is hard to prove unless you have a direct deposit from your employer and these are the only deposits that go into your account.

      If you are not on social security, pensions, etc, then you should attempt to get your paycheck as a paper copy. Once you cash the check, you can load funds onto a variety of MasterCard or Visa debot cards to pay most of your bills. I know this may sound like paranoia, but hindsight is hard to live with after the funds are seized.

      As BB stated, onc eyou share your account info through online payments, it is OUT THERE. Best thing to do is start over with a new bank account. When creditors/CAs call me I simply tell them I do not have a bank account any longer that I can use to make payments. Things get real quiet on the other end of the phone. Eventually. they all go back to reading some script in from of them and you have to be patient and in a kind way say, "what part of what I just told you, did you not understand?" LOL

        I NEVER EVER even thought of this double dipping thing. I have been worried about both my bank account, and my wages being garnished as there is a lawsuit against me and I just got notice that they are requesting a default judgment. (I dropped off the paperwork to my attorney yesterday so I am hoping to beat the clock).

        However, this is a really good point. If they were to already take it out of my paycheck, and my paycheck is basically the only thing that goes into my account, they can't touch the checking account too, can they?

        Hmmmm.....
