    Got served this morning!!

    After 1 week of the sheriff deputy traying to get in touch with my dh, he ggot served this morning. Chase wants their money. The good news is I already have a lawyer who has all the papers and he is aware that someone is trying to serve us now we just have to drop th paper to him.

      Do not panic

      What is the summons?

      In most jurisdictions you have 20-30 days to respond to it after being served.

      Just file in that time and all should be good, be sure to call the lawyer or email him and let them know you have been served. They most likely will want to see it and add the case # to the bk petition.

      Don't worry to much if its the initial summons even after it expires it can take 2 weeks to a month before anything more happens Plenty of time to file
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        Chase is so aggressive. I had 20 days to respond and didn't. I am just going to discharge it later.

          fltoo if you didn't respond at all they'll get a default judgment. How soon do you think you'll file? If its in the next 30 days you should be okay otherwise they might get a garnishment in before you file.
          May 31st, 2007: Petition Filed by my lawyer
          July 2nd, 2007: 341 Meeting Held
          September 4th, 2007: Discharged and Closed.

            Hey JR

            I am in a two year waiting period that is up this Oct.(an innocent fraudulent transfer regarding the family)
            There was really nothing I could to do to ultimately prevent the judgment, so I just let it happen.

            I am judgment proof, just letting it discharge when I file.

              It is so interesting to hear how the same companies go after people differently. I haven't paid my chase since Feb. and my husbands since Oct. 07. They haven't been very aggressive. Told them in May that we were filing and haven't heard a peep from them.

                Chase is relentless with me. I wonder if this is any indication of how aggressive they will be if a lawsuit situation comes up.

                Any experiences?

                    Sick of debt, I have to go with JR, you need to string them along even if you respond, admit the debt, you will be offered some sort of mediation, I'm convinced. They want money, not your first born. Offer them ten bucks to stall them till you can file. DON'T GET A JUDGMENT. They can make your life miserable and take what you have left. 'Hub

                        I have (had) a Chase account that I stopped paying for in May 08. They hound me everyday and I give them my lawyer's info...but they still call asking for payment. I was wondering the same thing, "will they be that aggressive in court?" I guess we'll see...
                        May 2008 Hired 1st Attorney/Stopped paying CCs
                        May 21, 2009 Retained 2nd Attorney
                        May 28th - Filed for Ch 7 (FINALLY!)
                        9/11/09 - DISCHARGED!!!!

                          Of course they will hound you. They probably cannot get a hold of your lawyer. Until he/she actually files and Chase gets notified of your filing they'll keep on hounding you.

                            I guess the question on everybody's mind here is why is Chase more aggressive than say B of A?

                            I have a small HSBC and they hardly ever call.

                            Chase and Amex call incessantly.

                            Capital one used to call me every hour about 4 months ago, I caught up, am now late and no calls.

                            Interesting.

                              The new head guy is big on collecting debt. Chase has a great record on recovery.

                              Maybe they are trying to impress Tony Blair, their newest employee.
