    Closing Bank Accounts

    Hey everyone. I thought I would throw this bit of info out there. We had a cc from BofA. We also had all of our bank accounts at BofA and as you can imagine, they wiped us out. It was after we filed, they took every penny out of our account then charged us for multiple bounced check charges. Our attorney says they will most likely have to either 1) pay it back to us, or 2)turn it over to the trustee.

    The moral of the story: Close your accounts if you carry a card with them, additionally I would close them if you have ever approved an "auto-pay" to a card. Just be sure you disclose the closure to the trustee in your paperwork.

    They took our house payment. That was really hard, but it is what it is, and we got through it.

      I'm so sorry this happened, yes... I would think that since it was after you filed.. that they will have to repay the funds. I hope it's back to you. This is an all-too-common story and I hate it.

        That's why I'm not a fan of autopay. It takes control of your accounts out of your hands.

          We just opened new accounts at another credit union and kept 15.00 in our old ones, checking and savings. When we signed up we were scared the lady would run a credit check.....but didn't. We just got our new checks, debit cards and internet bill pay accounts. The atty will be filing this coming week

            wow im sorry that happened to you. i used to pay my credit cards always with my checking account, what i did about a month ago is i opened a wamu account online, but i havent completly made the switch, im still using my old account most of the time. im approaching the 60 day delinquent mark on my cards. soon enough ill change my direct deposit to my new account.
            retained lawyer june 08, filed may 09....341 on 6/26/09- went smooth! Glad to be part of the 60 day club .... AND- 6/27/09- got engaged

              Oh please do change your direct deposit. They waited for my husbands paycheck to post and took it all. He had it direct deposited every two weeks so it was a good amount.

                Hi,

                How long did it take BofA to hit your bank account? We aren't even 30 days past due yet, and I just opened a new account with a credit union, but I can't get my direct deposit cancelled until October. I'm a state employee and only get paid once a month so I really can't afford to have them take my pay check.

                BofA has got to be one of biggest thieves out there. They are the primary reason we are filing BK. We had been paying all of our bills on time, not over the limit, nothing adverse and out of the blue they jacked the rate on our Visa up to 29.99%. Our payment went up over $200 in one month. I won't feel the slightest bit guilty discharging their debt.

                  If a cc payment hike is the primary reason for your BK, I would think you were prime BK material and not realizing it.

                  I would say you should be thankful to BOA for making you realize you were in trouble sooner than later.

                  Personally, I didn't realize I was in trouble until it smacked me in the face.

                    I should have said, that they were the primary reason we are filing when we are, otherwise we probably could have stretched it out another year or two. You are correct we have been on this path for many years, but I have been very aware of it.

                    This is actually my second time through this mess, the first was about 15 years ago and I never filed BK, just made myself judgement proof at the time and eventually they all went away. Have a house and steady job this time, so will be going the BK route. Hopefully I'll learn something this time around.
