    student loans sent to collections?

    hey everyone

    i have a quick question , my student loan of 5k i think went to collections
    i know you cant discharge students loans in bk ,chap 7 is what im filing
    but is my loans went to collection , does that make it fair game? i mean it is now bad debt like everything else, i dont really know but any input will help

    Not fair game, you will still need to pay the student loans.

      Student loans cannot be discharged in BK. If you are in a 13, many districts roll your loans into deferrment for the five years, and the interest continues to grow.

      If you default, they can easily get a 15% wage garnishment. They don't need to use the courts to do this.

      On the other hand, there are methods to "rehabilitate" a guaranteed student loan that has defaulted.

        Is the outfit that you pay your student loan to the same as one that you included your bankruptcy? Example student loan through Chase, but also credit cards through Chase.
        While you cannot discharge student loans, and Chase knows that, they can retaliate by not dealing with you anymore by sending the student loan account to a collection agency to further flush your credit history down the toilet.

            Government-sponsored student loans first became non-dischargeable in bankruptcy back in late 1998. When the latest update to the bankruptcy law passed in 2005, that made private student loans non-dischargeable as well.

            BigBoy2U's student loans pre-dated 1998, so that's why his student loans were discharged in his Ch 7. That won't be the case these days.
