    Phillips and Cohen!

    Watch out folks...these guys are gonna send me to jail! At least that's what they told my mom when they called her trying to rattle my cage. I guess it's time to C&D these guys and start watching for blatant violations, maybe I can get my lawyer to squeeze 'em for some cash!

    I told my mom if she answers the phone from them again to tell them "He doesn't live here, do NOT call back. If you call back I will pass your violation of the FDCPA on to my lawyer and let him deal with you" My dad thought it was pretty funny, he was like "if people went to jail for missing payments there would be about 80 million extra people in jail right now"

    Anywho, I love these slime ball collection agencies, at least it's good for a laugh or two.

    LOL.. I take the same approach when dealing with these collectors. Have fun with them. Of course, it's easy to do this after you have already made your decision to file( I would have never did this before deciding).

    I also have fun with telemarketers. They call and I sit on the phone and talk to them for awhile. I ask them personal questions etc.. I used love when I had a roommate and the telemarketers would call and ask for the "man of the house" I would yell to my roommate "hey the phone is for you" :o)

      Back in my roommate days I remember one time when a telemarketer called, my roommate answered the phone, and they asked for the lady of the house. He said, "Well, there isn't a lady of the house, but you can talk to my roommate", he passed the phone off to me before she could say anything, I answered it and the lady on the phone was completely flustered, stumbled a few times then just hung up. Was good for some serious laughs.

      On the BK thing, I am pretty much "judgment proof". I have no personal property of any value, I'm self employed, and I don't have a checking account. I'll file sooner or later, but right now I have better things to spend my money.

        Oh, I've had problems with Phillips and Cohen in the past. This is one collection agency that you MUST send the Cease and Desist Communications letter by certified mail. They won't respond to one sent by regular mail.

        They are one of the very worst collection agencies I've ever had after me. They are extremely corrupt.
        The world's simplest C & D Letter:
        "I demand that you cease and desist from any communication with me."
        Notice that I never actually mention or acknowledge the debt in my letter.
