Anyone have a timeframe for Chase/WAMU to sue?

    Anyone have a timeframe for Chase/WAMU to sue?

    Does anyone have any personal experiences with a delinquent Chase or WAMU credit card, Chase now owns WAMU so they would apply in both cases.

    These are the only two that I am worried about judging from some other posts.

    I am waiting to file a 13 for several months.

    Hopefully all of you can provide some insight!

      Nope, I got 1 phone call for the Chase account that is about 2.5 months behind, and told them Im filing a 13, here is my attorneys phone number.

      WAMU, was nothing but automated recordings.

        You did the right thing by telling them about your filing and giving them your attorney's phone number.
        BUT - close any bank accounts - especially those accounts from which you paid them before either online or by checks. They have your banking information.

          Ive read that they can only do that if there is a cross collateralization clause, or if I had automated payments setup.

            And that's exactly the danger - if there is a cross-collaterization somewhere in there small printed. They can rob you blind.
            Same with the automated payment setup system - they have your current bank account info. They can rob you blind.

              Actually, they can ALSO do it as a "right of setoff". So if you owe WAMU cc and have a WAMU account, they can take the funds from the account to pay the cc.

                I dont, I have a credit union account, not affiliated whatsoever with Chase.

                I have read some posts about Chase accounts and the CA they use to harass you, I just need a timeframe on when they really sue you.

                  I stopped paying my Chase CC in mid May '08 ($27K balance) when I retained my attorney, we were suppose to file at the end of July '08, but due to trying to pay the attorney fees in full before we file, our file date has been pushed back to <hopefully> file at the end of this month. To this day, we have not heard a peep from Chase after we told them we were filing for BK. We also bank with Wamu (now Chase) and nothing has happened to our accounts (yet).
                  May 2008 Hired 1st Attorney/Stopped paying CCs
                  May 21, 2009 Retained 2nd Attorney
                  May 28th - Filed for Ch 7 (FINALLY!)
                  9/11/09 - DISCHARGED!!!!

                    Jeez, based on that I shouldn't be worried then. The balance owed was only $2500, you'd think they would base their aggression on the amount owed. Thanks Liz

                      Ahhhh, that's "chump change", they have "bigger fish to fry" (like me)
                      I don't think you have anything to worry about.

                            I've not made a payment to Chase nor Wamu since May of 2008. Once I told Chase in June that we had retained an attorney, not one call or letter from them. WaMu called constantly in December, several times a day. That stopped within a day after filing, however.
                            Filed CH13 12/31/08, abandoned March 09 after losing job.

                            Ch7 Filed March 2010. 341 Meeting April 2010. Discharge and Case Closed July 2010.

                              Chase use to call my dad all the time. Then they stopped when my dad told them he was filing. Then a few days ago they put the account in collections and he had to tell the collections company he was filing, they weren't very friendly.
