    what does this mean

    We just got a call from Chase that one of our cc accounts with them that had already gone to collection agency was going to go against our credit rating. (?)
    We were supposed to file bk 13 in Jan but are waiting now till march so we can be behind on our mortgage by 3 months.
    My question is, what does this mean?
    should we be concerned ? I dont really know what he said because wife talked to him so...
    Are we screwed because we didnt file bk yet ?

    Means nothing. If you are delinquent in your payments it is reported to the CRA's and listed as 30 day, 60 day, 90 day...whatever is appropriate. If they send the debt to the CA, then the CA will start contacting you and list the debt as in collections by xxx CA.

    Yes this affects your credit score. But, so will the BK. You are filing, so it really does not matter to you (or shouldn't matter at this point).

      If you want to slow down any reporting to CRA's before you actually file, then send the CA a letter disputing the debt, and demanding verification of debt. In my expereince this has been beneficial in that of all my creditors (approximately 22) and CA's did not report anything to my credit reports as a collection account except 1. If you are close to filing then I would think worrying about whether or not something goes against your credit score is the last of your concerns. Once you file your credit score will decline anyway. In terms of how fast a CA can act against you? Not too fast if your open and read your mail and exercise your rights under the FDCPA and FCRA. There are MILLIONS of Americans who do not depend upon their credit score. Hopefully, you will eventually find that unsecured credit is not all that necessary if you budget for expenses and emergencies in the future. BK will get you to this point, What you do with this will evcentually be up to you.

        So when do you send the letter of dispute? When the CA starts calling?
        With Amex, they charged it off on my personal report before a CA started calling. As for Amex themselves, they really didn't call at all. Just a couple of times to ask when we were going to make a payment. After a few months, we just received a notice of charge off.
        How do you slow down the reports of charge offs???

          You don't "slow down" charge-offs. These are necessary accounting moves. If you hear from a CA by phone, then you need to ask them for written information via mail (AKA dunning letter.) Once you receive the letter from a third party debt collector, it is up to you to respond and request debt verification. You have 30 days to respond. If you have ignored dunning letters from CA's and you are outside your 30 day response time, then the best you might hope for is to send them a cease and desist telephone communications. There are plenty of threads on this forum related to addressing and dealing with third-party CA's. you might want to read them.

            I'm just a little confused...
            I've read on here NOT to speak to them, which I have not because I know I cannot pay. I get flustered easily and I'm afraid I might say something I shouldn't!
            But you are saying I should speak with them in order to have them forward their request by mail so that I can file a DV within 30 days?
            They have been calling me since Nov. 2, however, I've never once answered a call. Are you saying there is now no way to DV with them?

              You can DV at anytime - the 30 days is to preserve your rights. But you are filing BK - that debt will be discharged in your BK.
