Just don't do it to Associates Receivables (also known as NEMDEGELT) out of Metter, GA... this sucker is sue happy. He uses a law firm known as Reynolds and Robins. The file a bunch of lawsuits all over Georgia but never seem to actually go to court. Everything is either won by summary judgment or default judgment... Neither of which I was going to let happen. They sued me over an Ugly Duckling debt and a few months later over a Bank of America card. Neither case made it to court before my chapter seven got filed.

What happens if you get sued by a CA, they win and you don't pay?

High-Five on those bastards. Glad you put them under with a Ch. 7.
I would GLADLY fight those suckers. I would go to any court room of their choice and tell the judge the way it is. They would never get a dime from me. If they won a default judgment, I would tell them to go pound sand. I'll simply buy cars and get credit in other people's names then. Nobody will ever get a lien on any of my stuff unless I want them to.
There's always ways around it.

debtmonster, your so out of touch its sad, I am sure Treehugger who has been sued can tell you how wrong you are. And from me, I used to do collections, repo's and serve papers. I had one credit union that the collection manager sued you in small claims court if it was less than the $5K limit. I was the one who served the papers on those people. Plus I had a couple other places I served papers for and people get sued daily for not paying on CC's and loans.
There is post after post after post of people that have been sued on this forum. I personally have sued three people, so I know its not all smoke and mirrors.
You really can't be this ignorant.

From what I have seen in some of your other posts, I would say your sucess in that of not being served is that it appears you move around a lot.
In the 90's I dropped out of radar and didn't get sued, although one insurance company did sue but nothing happened with the law suit).Golden Jubilee was a year-long celebration held every 50 years in which all bondmen were freed, mortgaged lands were restored to the original owners, and land was left fallow: Lev. 25:8-17

The facts:
-I've owned a house for over 3 years
-Have 2 vehicles in my possession
-Tallying everything up for the attorney I have at least 62 creditors, collection agencies, hospital bills
-Total exceeds $350,000 if you add them all up
-House is in my name
-Credit report currently shows 17 recent alerts for lack of payments
-I live about 30 miles from the court house (in the boonies)
I know when I had a repo in 2006, the repo man did not want to drive all the way out here unless he was sure I was home. He called me several times in advance. I think he was working out of a place that was nearly 2 hours away.
One thing I am wondering about the house when I try to include it in the bankruptcy, though. As nice as this house is, I do not want to keep it. There's no future outlook for any good paying jobs whatsoever. All of the jobs paying $45-70k/yr. are all 2-3 hours drive from here (I did not know that at the time I purchased the house. I was unemployed when I bought it doing an MLM to make money.)
I am wondering if laws are being worked on that will force me to keep the house in the bankruptcy and that they will just knock off a huge chunk of the negative equity. I owe about $140k now or so. What if they were to bring it down to $80k and do a loan modification in the bankruptcy court?
That would be nice of them, but the fact still remains that I need to move away so I can get another job.

Debtmonster - For some reason you keep going over and over and over trying to avoid the fact that you are insolvent and unless you hit the Lottery with what you owe and all the creditors involved, with no job, no assets or equity, you are bankrupt. Unless you have income to pay a mortgage at any modified amount, you will not be able to do a modification because the bank or any lender just will not take the risk. No one can force you to keep a house if you are insolvent. You are moaning about where you live and that you can't get a job in that location and you are still talking about doing a loan modification on your house? For some reason when posters frankly answer you with excellent advice, you still just don't seem to get your situation. I understand you have retained counsel or have seen counsel? If you have retained counsel as I believe I have seen in one of your postings somewhere, you should be aware of what can and cannot be done as to your situation._________________________________________

My question is, how on earth do they know if I am employed or not? Where is the database for the person to show where they work? Last I heard, people can't pick up the phone and call the IRS and say, "Hey, which company was John Q. Public employed at when his company paid their quarterly taxes?"
What if I changed jobs 2 years ago and never applied for credit? What is the trigger mechanism that allows creditors to find this out?
There's way too many unknowns and that's why I am always in the dark about a lot of this stuff.
I did have a job for a good year and a half and nobody said anything then. At one point we were making almost $100k per year, but most of that went to taxes and car expenses. We had 3 cars with payments of $2,000/mo. and my gas bill was $600/mo. for commuting. I let one of the vehicles go when I lost my job. Then with my self employment, instead of paying the taxes, I've been paying on the car all this time and not putting any money away for taxes. Well, not it's time to pay the IRS and I have to stop paying on the car. Thing is, you can go a whole year and not pay the IRS. You can't do that with a car. They'll take it away.

Some of these debts are multiples or more, so your real debt is less then $350,000 - probably $250,000 or less. No, most of this debt is all unique. There's only a couple duplicates where the creditor is on there for an amount and then a collection agency is also there with a similar amount. It's close to just over $355,000 or so.Originally posted by BigJohn View Postdebtmonster said

No. She had to quit her job so we could hurry and get under the means test. At one point I had some $4200/mo. checks and she was making about $1000/mo. That put us $1000/mo over the median. Now that both of us don't have jobs and I only have the MLM income, our income is drastically dropping. Last month I barely made over $3000 gross. This month should be similar.
