    Lawsuit creditor question

    okay so most of you remember that I posted about Citi Financial suing me on the 31st day of being late on payment.

    They told me on the phone TWICE that I have a court date March 10th. I have yet to be served or receive anything in the mail!

    They know I retained an attorney weeks ago and my lawyer is about to file my chapter 7 if he has not already.

    What do I do if I do not get served? I need some notice for work and need to know where and when. Citi will not tell me!!

    Im pretty sure that they are just saying things to try and get you to pay. Have you tried contacting your courthouse to see if anything has been filed under your name? You may be able to check online too. Im thinking you're probably still at the same address so if there was a lawsuit, you could be served. Just check with your local courts to be sure. Like I said, they're probably bluffing.

      Thats what I thought but I called them tonight and they SWEAR I have court date March 10th!

        Ask them where the court is located. Or, check with your local clerk to see if a suit has been filed in your local jurisdiction. If you are filing soon, be sure to tell your attorney.

          Get a name and address and send a certified letter to the person asking what court and if you have been served. Bu doing this, at least you are covering some of your bases.
