DV/C&D dent on 2/19 IGNORED

    DV/C&D dent on 2/19 IGNORED

    I sent GC services a DV/C&D by registered mail, Return receipt requested on 2/18/09 to all 3 addresses on the dun letter. I have receipts that all three were received.

    In today's mail was a dun, offering 50% off my citibank balance.

    Where is my debt validation?

    If you send them a Cease and Desist letter, and if they honor it, then they don't bother you again. As for your Debt validation, that generaly gets cancelled out if you do a Cease and Desist letter.

    But then, they send you a 50% off your citibank balance letter, which probably violates the Cease and Desist letter........

    As for your Debt Validation, they can't try collecting the debt for 30 days but it doesn't mean they got to prove anything.

      Either way, it was a violation.
      After rereading my letter it wasn't a true C&D it was a DV with a communication limitation. It simply said:

      To Whom It May Concern:

      I am sending this letter to you in response to a notice sent to me on January 22, 2009. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

      Please limit your communications with me to written correspondence as it is inconvenient for me to receive calls at any time or at any number.



      It was mailed on 2/17 and received on 2/19. The letter I received today offering the spectacular, limited time offer of 50% off was dated 3/13.

        Send them another letter. Send copies o fyour first letter and a photocopy of their acceptance of the CMRR. Make sure the offer came from the CA an dnot the OC. The OC can do whatever they wish in most states.

          So, you have a violation of the FDCPA, what exactly are YOU going to do about it?

            My original post was intended to be sort of tongue-in-cheek, as evidenced by the use of the smilies, but I guess that didn't come across so well

            I reported it to the FTC and the Florida AG. That is about all I can do.
