when bk is dismissed..

what happens to creditors when a bk is dismissed and not refiled?
i assume they are notified, but do any of the debts fall through the cracks and disappear???

When a bankruptcy is dismissed and not refiled, the stay is lifted. You no longer have protection against the creditors. If you are already in Chapter 13, some of the money will go to the Trustee and some will go to creditors.

Have you though about converting to a 7?

i was just wondering... my lawyer keeps saying to file for a 7, with a probability of getting a 13.... he says just to walk away if i get converted to a 13...

for the life of me, i cant figure out why i would want to even bother, if i would walk... would some of the creditors give up or what?

Posibly they would give up. Some did on my C7, and never acknowleged. However you also could be sued. Small claimes court judgment is just as good as any judgment. You don't want that. 'Hub
