    New Horizon

    the last couple of days i've been noticing New Horizon on the caller ID, but they never leave a message.

    I was home all day today, never left the house or was online, phone didn't ring once. I got a call from my boss, New Horizon called my work looking for me and left the guys name and phone number.

    So of course i was mad, called the 800 number and got a girl that could barely speak english. She couldn't find why they called me. Finally she found it, and it turns out it was my husbands debt, an old providian credit card, i wasn't even an authorized user of that card. So i informed her that i was not to be called at work, she started yelling at me that if i wasn't such a deadbeat they wouldn't have to call me at work. Of course the fact that my name was not on this account didn't even seem to faze her. So I asked for her supervisor, got this jerk named Terry Cummings, who didn't want to tell me his name.

    So I informed him that neither me or my hubby was to be called at work. He rudely informed me that i didn't have the authority to tell them not to call hubby at work, i have no control over it. This guy was such an arrogant &@%#$$% i couldn't stand it. He called me a theif, liar, white trash piece of scum. Then i informed him of the bankruptcy, and it got even worse. Every time he would slam me, i could hear people in his background laughing. I asked for his supervisor, but he claims that he's the owner of the company, which trust me, i highly doubt.

    anyone else ever have to deal with these creeps? i checked out a site to post consumer complaints, but didn't find them there

    hopefully i'll have the paperwork all finished by the end of the week... i can't wait. this place is a prime example of why we're wiping the slate clean. I realize that we should have paid the bill, but he doesn't know what our family has gone through in the last few years... my son was born a preemie after i had a 5 week hospital stay, he stayed another 3 weeks. that bill itself was almost 200,000 bucks. then when i was preggo again i had a heart problem and nearly lost the baby... i had heart surgery last year to try and correct the problem, but it didn't work so i'm on expensive med's for the rest of my life.

    how dare he pass judgement on me?

    Can you record while on a call w/ them? So much of what they did is a violation (obviously). Even not wanting to give you his name.
    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

      OH GOD!!!!!!!! I would love for you to get these jerks busted! They are going way, way, way too far. I wonder if it is legal to record the phone call. If so, you could record the berating bahavior you are being faced with. Who the hell do these people think they are to treat you, or anyone else, in that manner? Especially when you had nothing to do with the account. Thank God you are filing. If they call again after you BK is filed, you can bring them up on charges.

        You COULD sue them, but since you are planning to file BK, any awards would just become part of the estate, so it's really not worth your time. Either get a recorder attachment at Radio Shack (I think mine cost $25), or just tell them you are recording the conversation - if they've got any brains at all, they'll hang up. Don't engage them - it'll just give you hypertension.

          thanks for the positive feedback... and yes, my blood pressure was very high last night, especially after i got to work and heard more details about their phone call. Turns out that when the guy called, he asked for me and was told that i wasn't there. So he asked when I came in. Amanda, my boss, asked if this was my husband... so he says... "uh, yeah" She thought it was very fishy, cause I work around my hubbys schedule, so he would automatically know if i was there or not.

          turns out he also called my mother in law, i'll be sending the cease and desist letter out in tomorrows mail, thanks for the link

            Tracy - what is New Horizon a collection agency? There is a New Horizon in Tennessee but it is a computer school of sorts. I have problems with Providian too and in fact they were so hateful to me when my payment was initially late for the first time in 10 years. They called me constantly until I filed. You dont have to take that kind of harrassment or abuse. Under the Privacy Act they are not supposed to call you at work w/o your authorization. I would not allow them to get my blood pressure up - simply dont talk to them. Hopefully you have caller id. At work I would inform your boss that they are not to accept calls from the company. It will be over soon - try to hang in there.

              Poor Traci. My heart goes out to her for having to endure that.
              Let's think about this for a minute....

              This guy is calling you a scum bucket piece of s$it right - over somebody elses money. He's not collecting money you borrowed directly from him - but rather monies you borrowed from someone else. To think - that he would berate you over something he has no personal interest in - this guy is a pretty low form of life.
              Do you wonder why he has that job in the first place?

              If you haven't filed BK yet, you should.
              But if you haven't, here's some pointers:

              1.) Send the company a Certified "Cease and Desist" letter with return receipt requested. They have to sign for it and the signature receipt is returned to you. This is the only "legal" way to notify collectors to cease and desist. They don't have to honor anything else, but this.

              2.) Never believe anything they tell you. While they are collecting the debt via telephone, they are simultaneously filing paperwork with the courts to file a suit for judgment. If you pay them, they dismiss the suit.

              3.) Get privacy manager. You can block calls from certain numbers.

              4.) Get a private unlisted number for personal calls...then forward your phone to their office. That really pisses them off.

              5.) If they do catch you by accident, hang up immediately. Don't start talking. As soon as you start talking, you will become emotional and you will be the loser.

                I filed wednesday and haven't heard anymore from these jokers... it still gets my blood boiling when i think about it.

                I had privacy manager, but they were able to get through it, since their company name was on the ID. I actually took the privacy manager off yesterday, and any creditor that calls i'm advising of the filing, case #, and even what page of the schedule they are on. Most are being very nice, there was one credit card that wanted a "good faith" payment. Yeah, right, that's gonna happen. I advised i used their good faith payment to pay for the filing, thats my faith! lol

                we had a van loan, but turned the van back in to them in July, they called yesterday. I advised of all the info, and then the jerk told me he'd be speaking to me in a couple of days regarding the bill. I told him that i believe it is illegal for him to continue to try to collect the debt under federal bankruptcy laws. (we filed pro se so i can't send him to my atty) he told me he could call any time of the day with something as simple as the correct spelling of the street we live on.

                so, i've started keeping a log (reformatted the creditor matrix into a spreadsheet) of every creditor i talk to detailing day and time of call and the person i spoke with. we'll see if it helps
