    Who must appear?

    If my husband and I are both served a summons for the same card...do we both have to appear in court or can just one of us go as representation?
    I don't see any reason for both of us to lose money by missing work.

    If you owe the money and don't want to fight it then neither go. If you don't go they will automatically give the judgement to the creditor. But if you owe the money then that will happen even if you do go. Really no point in showing up in court just to say "ya, I owe the money..."

      Be sure if your claiming bankruptcy to include this judgement!!! Then you can get it dismissed.

      If not claiming bankruptcy, you can expect them to now garnish wages to pay the account.
