    collection question and how to pay

    I've gotten a bill from a lawyers office to pay a bill owed to mbna bank for 2.000. The law office said they called the client and they would accept my payment of $100 per month. I don't want them to get a hold on my checking account, what is the best way to pay them an still have a record of it.

    I will pay more money as soon as I have it.

    Is your checking account with MBNA?? if not they can't get to your account unless they have a judgment on you. Do they have that ??
    Secondly, is this "letter" a real summons from a REAL lawyer??......SOOOO Many collection companies use this "fake" title "Law offices" to scare you into paying. Research the company find it is they are legit, and if so, try to work something out with the original bank.

    We had a collector calling saying they they were going to sue me, over a debt from 6yrs ago. Anyways I found out they didn't even have a license to practice law in my state. They are big time bottom feeders!! See if everything checks out, and consult a lawyer!!

    Oh and as how to pay a debt. I would do EVERYTHING in Money orders, that way you have a receipt and they do NOT Have your bank information.

      im assuming you are not planning to file bk. if you are then dont pay them.

      if not then as pink_amu stated they cannot take money out of your accounts unless and until they win a civil judgement in court.

      rememeber that if you start paying money and then stop then the statue of limitation starts all over and will stay on your record longer as well as allow them to keep trying to collect longer. without suing you they can only try to collect for so many years.

      each year that goes by allows you to pay less adn less on it due to length of time they are obviously not going to get the money. it the original was $2K over 3 years ago then it should be a lot less today and a lot less in another year as well. most go down to 80% and then 75%, 60%, 50% and then 40% etc.

        I didn't explain correctly. I am shook up. MBNA charged off 2000. Went to ecast collection agency $3,000 thou. plus. Paid $1200 and quit paying. They then sent it to Calvary Portofolio and I paid $600 in 2004, and stopped again, couldn't afford it. Then I'm so stupid I checked my credit and disputed it on my credit record as someone stated for me to do some times ago and then Calvary started calling everyday. Calvary sent a letter to us and now the next thing I know 30 days later I get a letter from a law firm Pollock and something in Lincoln Nebraska wanting a payment by 3rd febr. or they will go from there. So I made arrangements to pay. I want to pay them off and just rid of them I don't want any judgements on our credit report. It is bad enough as it is. I have been paying bills on time now for 8 months and my credit report is coming up even though it is still a struggle.

          well, now that everyone has gotten a peice of the pie im not sure what to tell you.

          you want to pay it off regardless then i guess you know the answer. call them and give them the money.

            I would make them prove they have the right to charge you all those fees, etc.

            I seriously would. Make them send you an accounting of how they came up with the 3000 number. Are they licensed to collect in your state? check your state's laws to see. if they are required to have a license then find out if they have a license. These places count on us being stupid and uninformed and think they can ram rod you. Are they threatening to have you arrested? No can do, its a civil matter, not a criminal matter.

            I would send them a letter CMRRR NOW asking them to validate they have the right to collect the debt.
