    Phone calls from Providian

    I was getting at least 3 phone calls a day from Providian (now Washington Mutual), even on weekends! So, I thought I would try something. I know that the Fair Debt Collection Practices Act doesn't stop the original creditor from calling, it only applies to third party collection agencies, but I was sick of these calls. So, I called Providian back and they of course wanted to talk to me about making a payment to them, but I just said, "I want to be put on your Do Not Call List." And guess what? She transferred me to her supervisor, who then told me that they would do that, but that I would no longer receive any calls from them whatsoever-- no more possibility of making any deals or payment arrangements with them over the phone, etc. That's fine with me, since there's no way I can pay back what I owe to my credit cards anyways, so why bother making any promises I can't keep. And then all the calls stopped. What a relief! She told me I still had to follow it up with a written request to stop calling me, so I sent that off in the mail to them yesterday.

    This is totally voluntary on their part, but it's worth a try with any creditor you have. Simply call them back and ask to be put on their Do Not Call List.
    The world's simplest C & D Letter:
    "I demand that you cease and desist from any communication with me."
    Notice that I never actually mention or acknowledge the debt in my letter.

    That's great but they will just send it to a CA and they do not have a do not call list.

      But, a CA is bound by the FDCPA and must honor a cease and desist letter.

        You realize of course if they turn your account over to a CA, according to the FTC, if you tell the CA to cease and desist they are allowed one more contact to tell you they will not bother you anymore or what specific action they will take against you to collect the debt. Some companies also hire another CA to do their collecting and the whole process might start all over again. Bottom line is if you owe the debt they will try and collect it. Telling them not to call you will not stop the collection process altogether.

          It will still bounce from CA to CA and still keep you busy on the phone. It's better to get caller ID and don't answer those calls.
