If my home gets foreclosed on in the middle or after chapter 7 bankruptcy how much time is typically given for me to move? I am not in forclosure now but I am behind 15 days my mortgage co says dont be more than 45 days late or they start foreclosure well the last day for objections is 07-20-07 and if I dont come up with the money before then how long before I have to move typically in GA we did not reaffirm we filed pro se

With the right clause in the mortgage contract, Georgia allows mortgage companies to foreclose without going to court first which will speed up the foreclosure process to as quickly as two months. HUD has suggestions on who to contact for legal assistance in Georgia if your lender is threatening to foreclose - http://www.hud.gov/local/ga/homeownership/legalaid.cfm . It's always worth asking a bk lawyer if you can have a half hour of free consultation to ask a few questions. Technically, they can start proceedings at day 31. There are some steps they have to follow, by first notifying you of the default (registered mail) and giving you a date to cure that. Next, they have to file the foreclosure notice and advertise it for 4 consecutive weeks in the local county's official newpaper. In the Atl area that is NOT the AJC. The sale is scheduled for the first Tuesday of each month, so depending on timing, etc. you should be able to calculate a rough date. At any rate, if you're in bk they have to obtain a Relief from Stay before any of that can begin. The last day for objections probably won't be a factor, because if they get a relief from stay, they are allowed to proceed without the limitations the stay provides. Good Luck.

I moved from my home in Jan. 2003, thinking I would have the sheriff at my door if I did not move out, the house had not been foreclosed on until Sept. 2006. So technically I could have lived there the entire time.
I have not lived in it for over 4 years, but they did not do anything with it and it was apparently vacant all that time.
Will they do the same with you, I wish I had an answer. All I know is I wish I had not panicked, because I would not be in the financial mess I'm in right now.
Consult with the Mortgage Company or a real estate attorney ($300-350, but worth it).
I moved to Florida and had a job offer in Atlanta a month later. Go figure!
Sometimes it's okay to sit tight.
