I asked this question on another forum, however this may be a more appropriate place. I was in several workout plans with my lender, I missed my 2nd payment of a 6 mo agreement this month. When I called, foreclosure dept answered, said my case just went to their office last week. She said I may be a candidate for modification. Should I be working with her, or with loan counseling department. I had heard once loan gets to foreclosure dept, their mission is to run it through quick as possible.I am expecting a pay increase soon, so if I can just get current, my wife is also working now, I think I will be alright. Anyway, if they do continue on foreclosure, what could chapter 13 do for me, will it rattle the lender if i mention i''m considering that? Any advice would be appreciated.

Frankly lenders are told all the time that a debtor is "thinking of filing bankruptcy". It's completely meaningless to them.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

I am recently divorced after 30 yrs. My husband handled ALL our finances so I'm struggling to get on my feet. The court ordered him to make the mtg pmts on our marital home in which I live. He is 3mos behind on pmts and wants to auction the house before they foreclose. If we do that I will get no money with which to move into a new home. I am disabled and our credit is shot so I can't get another loan. If I file bankruptcy and exclude the home, do I have to stay in the home for any time or can I sell it?
