    paid to vacate premesis??

    Just out of curiosity I was wondering if anyone had the experience of a this?

    My sister-in-law filed bankruptcy (chpt 7) a few years ago. I'm not sure how long she remained in the house without paying. Anyway, she said that the morgage company told her if she would vacate within 30 days they would give her $500. It worked out for her and she accepted the offer. She said that the man told her that it cost so much money to evict a person and that it was common for a settlement to leave to be offered.

    I filed bankruptcy and it closed in august of this year. I don't really plan on making them "force" us out. But, I was curious if anyone else had experienced a "pay to vacate" type of thing. (FTR, I live in Illinois).

    Also, if anyone has experienced giving up their house with bankruptcy, how long did it take for them to contact you. I'm worried that when I move, someone may break in and trash my house and they will try to hold me liable for it. I've heard nothing at all from the mortgage company or car company or anthing as of yet.

    How many payments are you behind? Don't worry, the calls will start soon.

    As far as "trashing the place and holding you liable", that is why you have property insurance. If you are concerned about your personal belongings, then take pictures of all of it and keep them elsewhere, so you can file a claim if something does happen - which I doubt it will.

      We filed in June, had stopped making payments in February and our house is going to tax sale this Thursday, soooooooooo, from the first missed payment to foreclosure sale in Michigan was 7 months.

        If lender found new buyer for better profits... sure lender can give $$ to owner vacate quick... but if there is NO equity left.. I doubt any lender would be willing to give away $$... because they loose anyway...

        Last few years.. 2000-2004, real estate is a quick-rich dot.com stock bubble market.. now it is just a sinking mud hole!!!

          im part of that sinking mud hole, thinking we signed up for
          a fixed rate, i just found out today, it is adjustable.

          When signing a contract, never ever take your lenders word
          on anything, and that should be made a sticky....

            if you have already filed BK, and your house is included...I would say you would not be responisble if someone even burned down the house, after all you said the BK is now closed? how is it even possible that you are still allowed to live in the house? but if you are waiting for someone to issue you a check for you to leave, thats probably a long-shot....I am confused about the house, was it your house in your BK, or is this her house? it really does not cost that much to evict someone...they file the proper amount and paperwork with the court showing proof of whatever needs to be done, after the legal time has passed, the sheriff will get you out weather your stuff is out or not. Im not sure what the exact court cost is, I thnk between $250-$500 / you will get a court order, so you can always go to court to fight the eviction, but if you do not show for court, you automaticly loose.

As far as my case being closed, I was told that I would be able to stay in the same house for at least 6 months (lawyer told me it was more like 9mo to a year for the forclosure to go through.)after closing. I'm not sure if it's just the process in Illinois or not. I don't plan on staying here that long, though. I already have a place to live lined up. But - do I hand over the keys when I move? Do I contact them to tell them I am moving? Or do I just up and move, lock the doors, and let them (mortgage co) worry about the house?

                those are questions you need to direct to your attorney, about your keys, if you are responsible once you leave, etc...
