Chapter 13 plan/foreclousure

Hi, we are in Chapter 13 facing foreclousure in Ohio
becasue of a strike my husband had and got behind on payments,but our plan was and is still getting paid.
My question is with the foreclousure will our Chapter 13 plan get dismissed,thanks

So if I understand this correctly, you filed ch 13 and were paying your mortgage outside of the bk. You are still paying the bk, but now have fallen behind on the house payments.

Obviously, that is too bad.....do you think you will be able to catch up and get current? The bk will not get dismissed at this point unless you stop making the ch 13 payments.

If you are making your Ch 13 payments on time, then your Ch 13 will not be dismissed.

However, if you aren't making your house payments, then your mortgage lender is going to file a motion to lift the automatic stay and start foreclosure on your house. To stop that, you need to pay the arrears right away. Another option is to ask your lawyer if you can skip a Ch 13 payment or two to catch up on the mortgage.

Go talk to your lawyer right away and find out what's possible to do in your case. Good luck - hope you find an option that allows you to keep your case open and saves your house too.
