    Florida Foreclosure timeline

    I received a certified letter yesterday - "Notice of Default and Acceleration" from Countrywide. We are 2 months late on mortgage. It basically states that the loan will be accelerated and foreclosure process will start if both payments are not received in full by 1/16/08. I have read from a number of posts that the foreclosure timeline in Florida -where we live - is 180 days on average. I have 2 questions:
    1) From what point is that 180 days an estimate - when we missed our first payment, or the date on this notice 12/17, or the 1/16/08 mentioned in the letter, or some time further in the future. I realize that the 180 days is only an estimate.
    2) We plan to file Chapter 7 in January or February and include the mortgage. We hope to stay in the house as long as possible after BK. Is there anything to consider in the timing of the BK filing that would give us more time to stay in the house. I mean as far as benefiting the most from the automatic stay and slowing down th foreclosure

      I just wanted to pipe in here that I stopped paying a mortgage on a home I had in Florida in March. Just this past month I received a statement from my mortgage company (For informational purposes only as I'm in an active bankruptcy) asking for my payment.

      So that's been 10 months since I last paid and it looks like it's still in foreclosure at this point. Hope this helps.
      11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

        I am in the exact same situation. I live in Florida and due to medical issues can not afford my home anylonger or my bills. I have had it up for sale for over 1 year with no luck. I am now planning on filing bk also in jan or feb but not sure if I should wait until the house is foreclosed first so I can include it in the bk. I will have to file myself as I do not have the money to pay a lawyer. I also would like to know the timeline. I know they have to be super busy with all of the foreclosures being filed these days. When do you have to leave the home? How much notice do they give you? Feel free to keep in touch.

          Well, our attorney says at least 4 months until we would be hitting the "leave the house" time, but it also depends on the lender. It could be 8 months or longer. We are with Countrywide. Does anyone have any information on their foreclosure timeline in Florida? I see information that you should talk with the lender through the whole process, which we have not done. We are definitely not staying here long term since I took a job 60 miles away. Is there any downside to talking with them, such as them finding out our intent to file bk and eventually leave the house? Thanks.
