I received a certified letter yesterday - "Notice of Default and Acceleration" from Countrywide. We are 2 months late on mortgage. It basically states that the loan will be accelerated and foreclosure process will start if both payments are not received in full by 1/16/08. I have read from a number of posts that the foreclosure timeline in Florida -where we live - is 180 days on average. I have 2 questions:
1) From what point is that 180 days an estimate - when we missed our first payment, or the date on this notice 12/17, or the 1/16/08 mentioned in the letter, or some time further in the future. I realize that the 180 days is only an estimate.
2) We plan to file Chapter 7 in January or February and include the mortgage. We hope to stay in the house as long as possible after BK. Is there anything to consider in the timing of the BK filing that would give us more time to stay in the house. I mean as far as benefiting the most from the automatic stay and slowing down th foreclosure

12/04/07 -case pulled for random audit.
12/18/07 -341 held: Asset case due to engagement ring & tax return.
02/19/08 - US trustee files motion to extend.
04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!
