Filed CH7 and moved out of old house. Need to get it out of our name.

    Filed CH7 and moved out of old house. Need to get it out of our name.

    Filed CH7 (included house in our CH7 BK - letting it go) and moved out of old house. Need to get old house out of our name. House has been sitting empty for 5 months! And I feel responsible for house....

    Is there anything I can do to get it out of my name immed?
    Send the keys back???? Deed in Lieu?

    I have 1st and 2nd with same mtg company....
    I talked to my atty's paralegal and he said "it has to still go through the foreclosure process - which is about 4 months in CA".

    I don't know what to do as I cannot afford liability coverage on the home and am concerned about stuff like the lawn drying up and becoming a "fire hazard" and then having the city fine me for not doing anything - or a kid getting hurt on the property - or whatever?? Basic liability stuff.

    Any help will be greatly appreciated.

    I talked to my Insurance Company. Did you have your insurance in with your loan? Usually the payment is for principal, interest, taxes, and insurance. I asked my Insurance company a similar Question when I was considering FC and they said they took the insurance in advance, so I was paid through the year, and to tell them when it was done and I would even get a refund.

    The people I talked to at the Insurance company were very sympathetic, and also did not want the house hurt, so I should think calling them and asking up front would be an option.

      my homeowners insurance is seperate from the mortgage payment....

      I stopped paying both a few months ago - then my mortgage company "forced" structure insurance on the home (because I stopped paying my homeowners ins), not liabilty ins.....(of course, they are protecting only themselves)

        sounds similar to my situation... i myself got chapt 7 discharged yet later bank bought the house on auction to resell. who knew?
        they posted exact balance i owed in my credit report even after bk discharged saying, unless they sell, they wont remove that balance i owe, and wont remove my name at county land record as the owner.

        how is this possible even after chapter 7?
