    National City is Fast!!

    They started foreclosure proceedings when we were 91 days late! It's more than ok because the house is vacant and I just want it over with! Our bk was filed in May and they have already filed the relief of stay! I'm just surprised how fast they move! I know some folks that have Countrywide and stopped paying last Aug and STILL no foreclosure proceedings filed! I talked to my lawyer today and they said they would consent to the relief of stay. What does that mean? Does that mean there is no hearing or anything? How long does that take for the relief to be granted and they can move forward?

    Sorry can not answer you're questions but agree they are fast. I was hoping to have more time as you mentioned since others have said they have over a year. National city started proceddings after 4 missed payments which was faster than anticpated but not as fast as you.

      Good news, but don't get too excited...we stopped paying mortgage payments to National City in Jan 2008, got papers starting foreclosure process in April 2008, filed ch 7 bk in June 2008, relief of stay granted in July 2008, bk discharged and closed by Sept 2008. House JUST went to auction in March 2009!

      The relief of stay just means that they have permission from the court to proceed with the foreclosure...there's no hearing unless you (or someone else) are contesting it for some reason. It should say somewhere in the paperwork the time period to file a motion to uphold the stay (or something to that effect)...I think it's something like 30 days? After that time if you don't contest the relief of stay, it will be granted pretty quickly (depending on how fast your court system moves...we're in KY and it was literally the next day)

      I know how you feel...I couldn't wait for it all to be over and for the house to just be *gone*! It's quite a relief it's finally over and we can move on...Good luck!!
