    Is wage garnishment considered a preferential payment if its more than the 600?

    Just doing some reading on preferential payments.

    If you have a garnishment in place, are those payments considered preferential if they exceed the 600 in 90 days?

    Just curious.

    Yes, those would constitute preferential payments, and the trustee can go after the judgment creditor for the money (if the amount is large enough to justify his effort). This, of course, would not benefit you, other than providing some emotional satisfaction. The garnished money would be taken back and after the trustee takes his cut, whatever is left will be distributed among all of your creditors. You wouldn't receive any money.

      Yea I figured it would go to the bk case, I wasnt expecting funds back. Its only to the tune of about eighteen hundred. IDK if thats large enough to warrant the paperwork or not.
