Sent copy of promissary note to trustee

I have a lien on my Florida title to my 2000 4Runner which I own outright.

Trustee wanted a copy, with the amount owed ($6K), so he can figure out if it's worth taking the truck. There's a lot of work that needs done on it...and it has 110K miles at this time...

I guess now it's a wait and see game as far as wether he wants to take the vehicle.

Will he have to pay off my mom, who holds the lein or is there a way he can get by that?

I have a friend who will sell me their car for under a thousand dollars, if the trustee takes mine so I don't have to walk to work...

It's now been a year since I filed and was discharged back in Feb.

SUV sucks any how...too much $ on gas and repairs...

Yes, the trustee wants proof that the lien papes exist on the SUV.....

Once in his hands, he will determine if the value of the SUV is worthwhile is him trying to seize.

Remember, he has to pay the lien off out of the sale first, then anything left goes into your estate to pay creditors......

But first he has to get the SUV thru the Court (time & expense), etc...

With high mileage, repairs, etc...... the actual value of the SUV now may prove to not be worth the effort......

Also I beleive he has to allow you the vehicle exemption for your state out of the funds - making them even lower.....

Long process, lots of expense, paperwork may really discourage him from trying to take it......

    Good luck, keep us posted.....

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

I wonder how long this is going to tak? I was so hoping to get some $ back from him on my IRS refund...which was sent to him in June...I know he's entitled to 10/12 as I filed last Oct. But in another thread, it mentioned that child tax credits aren't touchable? I have my two sons that I claim on my taxes...Will I ever see anything from my 2005 refund?

I wish I knew about the truck as then I could unload it and get something that's trouble free....I am so stuck with this truck...worst 4Runner I ever had.
