    Should I send out letters?

    I get lots of collection calls - including ones to my parents house...where I do not live. I posted yesterday about filing chapter 7...I have no assets, no income, nothing (except about $10,000 in CC debt). I'm going to file and have consulted with my attorney and paid her the retainer but $ is very tight right now and I'll have the rest to be able to file before the end of the year (husband is paying for it - he has good credit and is not filing with me...don't live in a community property state).

    My question is, should I send this letter to the collection agencies and law firms contacting me?? Thanks!

    Creditors can check your financial status any time they want. You don't have to tell them you're judgement proof.

    If you want the Creditors to stop calling other people, you send a Cease and Desist Letter. Tell the Creditors when and how they can contact you.

    If you'll allow calls to you via your home phone number, tell them that in a C&D Letter. Specify the hours and days they can call.

    You can state you only want letters of contact. You can tell them that they must contact you via USPS Mail only.

        Yep! That would be one good way to get contact info.

        Right after we filed, I got a call from an "attny's office who'd been retained to represent Chase" is what the guy said. The name and number showed on our Caller ID so I did a Google search looking for info on them. Reverse phone search. Took a bit, but I did find the Law Firm, address, and even mapped their location.

        We've started working on our Credit Reports since our 341. Signed up with a monthly Credit Monitoring Service.

        Guess who shows as having requested/inquired about my Credit??

        Yep!! That "Law Firm" who coincidentally happens to be a Collections Agency.

        Look in the Inquiries Section of your Credit Report. All of the Collectors that contacted us did a Credit Check prior to calling or mailing letters.
