    What do I do? Own a house in another state-

    My husband lost his job in August and it took a terrible hit on us financially. We did ok - but had to borrow against CC to make it. He has gotten a job - but his income is 6 figures LESS then before - our cost of living has gone UP by about $800 per month - and we own a house in another state.

    So here we are, considering bk. But my question is fairly simple. #1- how do you know if you are getting a good BK attourney and do we get an attourney here or in the state we have the house on? We are considering letting it all go.

    Advice would be greatly appreciated!

    How long have you lived where you are living now?

    It's practically easier to file in the district in which you live.

      Do you know anyone else that has filed BK where you're currently living? If yes, ask that person if they used an attorney and how they like him/her. If this isn't an option, I recommend interviewing several attorneys to see how well you work with him/her - you'll want to determine whether your personalities, values, etc mesh with one another. If you have a difficult time interviewing different attornies, then just use an attorney that specialize in BK and one that has done several BK's!!! Attorney's that only do a couple of BK per month wont have as much fluid knowledge as you like, and need, to get your BK petition going in the direction you want. The last thing you need is an attorney that can't answer elementary questions related to BK, without having to "look up the law"!!!

      The general rule is you need to reside in the town/county/state in which you wish to file at least six months to file BK. You always, do a remote filing or just have it done where you currently live once you have satisified the residences criteria of your state.
