    *Filed my petition last month but an asset has changed*What to do?

    Hi there, Yesterday I received my notice of bankruptcy with my 341 meeting date for March 31. I filed my bankruptcy petition saying that I own a 94 Camaro, but that it is exempt using the bankruptcy exemptions for my state. I just checked pacer, and the trustee filed this case as a no asset case.

    My problem is that, my boyfriends dad let me use the car for free to help me get on my feet. So the title was in my name, but basically his car. Well someone offered to buy the car, so he told me since I am not paying, he would rather sell it. He made me sign the title over yesterday. Since this car is exempt anyway, do I need to make any adjustments to my bankruptcy schedules? If so, what do I say? It is a wierd situation since the car was in my name but not mine to keep when someone else wanted to buy it. I tried to explain to my boyfriends dad that this is going to screw up my bankruptcy but he could careless. Please give me any helpful words!!! Thank you!

    It's a close call, but you should not change your schedules.

    The Bankruptcy Court rarely checks to see if a person has or does not have an asset (they determine whether you do or do not have assets simply by your oath at the 341 meeting - unless there is substantial, obvious fraud).

    A '94 Camaro on a schedule definitely won't attract a Trustee's attention. It's too old and not worth any money.

    If you change your schedules now, you could draw unwanted attention to your case.

    I wouldn't worry at all.
