Living Overseas

I've been living overseas for 3 years now. I was out of work for a few months last summer and fall, so I was living off cash advances from my credit cards. Now I am finally working again, but unfortunately have racked up so much debt I don't know how I can possibly pay it back. I've been paying the minumum balances each month with the cash advances that I took out.

Now, I'm seriously considering filing Ch. 7 bankruptcy, but will I be able to do this if I am not a current resident of the U.S.? I have an Iowa driver's license and am currently registered to vote in that state, but my tax returns show that I have been living abroad for 3 years.

If anyone knows about filing from overseas, please advise!

I don't think you can file "from" overseas, but I really don't know for sure. The proper Venue for a Bankruptcy proceeding is the jurisdiction in which the debtor has resided for the better part of 180 days, or where most of the debtor's assets are located.

I suppose you ought to contact a BK lawyer in Iowa to discuss your options.

Go visit the U.S. embassy or a consular office. I am quite cretain that they have staff to answer your questions and possibly assist you. Depending on the size of the country and size of the large cities in that country, the embassy is always located in that country's captal, but other large cities should have consular offices.
