    Filing without husband-income question

    From what I have gathered, if I file by myself my husband's income will also come into the picture. I understand that they can't take his assets that my name is not on, but do they consider his expenses too? For example, our house is in his name only. Would they factor in the mortgage of $990/mo?

    He makes enough to cover his bills, but I do not. Will the courts consider what he has to pay too?

    Our monthly combined expenses including the house total $3129.50. Our pre-tax income is $3000.00. The atty. I met with said we have too much income for me to file a 7. Does this make sense?

    Yes, you list his expenses on your shedules. However, depending on what state you are in, its not an accurate assumption that his assets are his assets and the BK trustee won't touch them. Most assets acquired during marriage are presumed community assets and therefore you have an interest in those assets. However, its generally not a problem because the exemptions will cover the assets, but you need to make sure you take advantage of the proper exemptions.

      We have been married only 6 months, so everything of his was acquired before the marriage. Do you think this will make a difference at all?
