    Car issue

    I have a car financed and I'm considering bankruptcy... not sure yet if I will do 7 or 13, but I know I need to do it asap.
    Once I file, how long do I have before they repo my car if I don't make the payments? How can I find out from the bank without them getting suspicious and repo the car immediately?
    After filing, am I able to purchase a cheap car ($2000) and surrender the financed car? How will that affect my case? Will I need to submit a document showing my change in expenses/assets?

    I'm already 1 month behind on my car payment and this month's payment is due next week. I'm trying to gather some funds together and buy a cheap car, then let them repo the other one... but I'm trying to figure out how much of a time frame I have.

    It can be tough to say exactly how long you may have. Some lenders are quick to repossess once you have defaulted the loan, while others may drag their feet.

    That aside, when one files BK, the lender will have to lift the automatic stay so they can repossess the vehicle. When the debtor receives the Notice granting the Lift of the Stay, even still, it can be hard to pin-point the timeline. Again, depends on how fast or slow the lender is.

    On the other hand, you can call the creditor and make arrangements for them to pick-up the vehicle. If you have not filed BK at this time, you could get a judgement against you for the deficency balance, but filing BK will eventually wiped that out in a Ch.7 or re-paid in a Ch.13. I WOULD NOT inform the lender that you're considering BK. My advice though is to not contact them. If you know you'll be filing BK (and hopefully soon so no judgements come against you), then don't say a word or make a call to the lender.
