hi there, my name is tiffany and i am new to the forum. i just wanted to tak a minute and tell my story and get some feedback. i am 26 and my hubby is 29. hi parents gave us a house about 5 years ago. we were very happy as you can imagine. well that year we found out that there were about $5,000 worth of back taxes. so we made a decision and took out a mortgage to pay it off. when applying for the mortgage, we found out that there were about $20,000 worth of debt that needed paid off, so we decided to pay them off and take out some extra for a new car and home repairs, out first mistake. my husband was working steady had a great job and we were doing well. well that came to an end in 2005, after our wedding. we ended up in debt so bad from the wedding on top of that, i found out i was pregnant with our second child. well that summer my husband was in a motorcycle accident that left him unable to return o work right away. he works in telecommunications so he works until november and goes back around february. we exhausted unemployment i was unable to find work. the bills piled and things just got worse. he was able to go back about a year later for a few months but buy that time we were in trouble with the house. the mortgage company was unwilling to work with us so in my desparation i called one of thoses home savers programs, big mistake. the took my money and did nothing for me but waste my valuable time. (yes i reported them to the BBB) well i was at the end of my rope by this point and unable to retain an attorney cause my husband lost his job. so i tried a banruptcy alternative, pretty much the same as home savers, another dumb mistake on my part . needless to say we were evicted from our home and had to leave. we have just movd into a new home bu there is more my story gets better. my husband had taken out a loan before we go married a personal loan. well the company sent a sheriff to tag our belongings. now, when we moved we were told by a shriff to take them with us. we are now being brough up on charges for intent to defraud creditors how nice. i am lost righ now and don't have the money to retain a lawyer as of yet. things are slowly starting to come back ogether but then this happens and i am clueless. we plan on filing chapter 7. well i just wanted to give my story and get some feedback, thanks for reading this

Welcome to the forum, Tiffany - glad you found us. So sorry to hear about all your problems. Luckily many of them will disappear if you file bankruptcy. What state do you live in? If you look back six months and add up husband's and your gross income, how much is it? Do you have two children? When did you last use your credit cards? Have you taken out any payday-type loans recently? How much equity do you have in your current house?
If you can share a bit more information, we'll be able to help you better. Again, welcome!I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

follie-you are very right there, i am. i have contacted the public defender and i think we are going to waive i to higher court only o buy some time and he said that we might have a better chance of working something out due to the fact that the district magistrate doesn't like either of us very much. i live in pa. our gross incom for the past 6 monhs is very sad, $2712. we do have 2 children 7 and almost 2. we havn't used our credit cards in almost a year. and we don't have any pay-day loans. we rent our current home.

Tiffany,
Contact you local legal aid department...... there are agencies in your state that handle bankruptcies for low income families at no charge except maybe the filing fee with the court. They will help you draw up the paper work and tell you where to file.
If you own no property (you said you rent) and depending on what state you are in, your case sounds like a simply Chapter 7 liquidation...... (this will remove all debts except taxes due, student loans.) And student loans CAN be dissolved in a hardship case.
Do not use your credit cards unless ABSOLUTELY NECESSARY (neccessities only - food, clothing, etc) and do it in small amount if needed.
Give us more information, state, income, size of family, assets (auto, home, etc) and we will try to help you and steer you in the right direction.....

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.
