    Wait time after last charges?

    i am new to all of this... as far as objections go, is the best rule to wait 6 months after your last credit card activity (charges, balance transfers from 1 card to another, even minimum payments to the cards) to file?

    i have also been living the balance transfer lifestyle in order to survive over the last few years.

    as far as the history that is over 6 months old, do they look through old charges and history as well?

    The best practice for cc charges is to wait to file for at least 90 days after the last charge.

    For balance transfers, it depends on the amounts you transferred and when. If the transfers were recent and over $1000, best advice is to wait as long as possible to file - a minimum of 90 days, up to six months if you can manage it. We have one current forum member who seems to have gotten away with big transfers within a month of filing (his case isn't closed yet), so there's no black and white here - just what most trustees and lenders may find problematic.

    No matter what, the more time that passes between your credit card use for any reason and filing bankruptcy, the better.

    Unless there's a suspicion you filed fraudulently, the trustee and courts will accept what is on your forms. What you have to worry about is how your creditor will interpret things. They can file objections to you trying to discharge what you owe them if they believe they can prove that you took the money knowing you are going to file and wipe out the debt. That's why waiting as long as possible between cc use and filing is best.
