    Credit Report...Is this debt really gone?

    I filed bankruptcy by myself in April and one of the things I thought was that if I had a federal stafford loan that it could not be discharged. I remember I listed it along with my income tax debt on my creditors list i forget which schedule. Im looking at my credit report now about 2 weeks from discharge and under experian under my student loan it says

    Is this debt really discharged? Can I actually forget about this debt? because I though this along with my income tax debt were here for good And my discharged isn't till about August 1st

    Unless you had a separate adverserial proceeding before a bk court judge, that SL will survive bk.
    Once the bk is discharged, the loan guarantor may begin collection activity.

      You are right - federal student loans and as of Oct 05 private student loans as well cannot be discharged in bankruptcy unless you can meet some very stringent guidelines that folks on total disability have trouble proving.

      Is your student loan in forebearance for now during your bankruptcy? Who's your lender?

      Once your bankruptcy is over and closed, regardless of what your credit report shows I'm betting that you'll hear from your student loan lender again and that your loans are owed in full. Bottom line is I wouldn't count on a credit report to confirm my student loan status.

      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED

        just call and find out, that is the best way. YOu will be amazed some things can be discharged. Our taxes are coming off and most people thought that BK can not discharge taxed but our can be included one 2000,2001, and 2002
        Success is reachable, stretch out your arm and grab it.

          Let's be a little more accurate here, most people on this board realize that back taxes "can be" discharged in BK "under certain circumstances", namely that the tax is an income tax, is more than 3 years old, for which a return was filed, and was assessed not less than 2 years before filing.

          Just realize, that what appears on your credit report has no legal significance vis-a-vis your obligation to pay a debt, the amount that is owed on the debt, etc. Remember, a credit report exist ONLY FOR THE BENEFIT of other creditors, it is merely informational so that other creditors can assess your credit riskiness.
