SCG, welcome to the forum.
Since student loans are not dischargable, I don't think it would be a problem, but don't get yourself into any more debt than you have to. I regret taking my student loans out to pay my CC.
Check into legal aide, and start getting your ducks in a row. I'm sorry you've been through so much.
We've all gone through the feelings of shame and failure, but, on this side of things (will hopefully be discharged 7/23!) I am filled with so much hope. I'm so happy I did this.Chapter 7 filed 4/23/07

This is my first post - I've been "lurking" for a while and I've learned a lot. I just want to give you some emotional support - don't be ashamed of what's happened to you. Just pick yourself up and go forward. Sounds like BK is the best option for you, but I'd think long and hard about the student loan. Maybe your attorney can work his/her fee into the BK? Worth asking. Keep looking for the answers and you'll find them. Don't give up.
I've just decided to file BK - the calls haven't even started yet, but will any day. That's going to be really hard for me. I've never even paid my bills late before. It will take me several months to come up with the attorney fee, but I can do it. If I can make it through the calls, I honestly think I can live through next 5 yrs (I'm hoping, anyway). I'm really worried about getting calls at work. I appreciate all the good tips I've learned here about ways to handle the calls. I initially thought I would talk to my creditors and tell them what is going on, but after reading many posts, it sounds like I would just be wasting my breath.

This is the way it IS!!! Financial problems happen, medical problems happen, and divorce can throw our lives into a tizzy........
Bankruptcy is NOTHING TO BE ASHAMED OF, nothing to feel guilty about, nor to feel like you have FAILED along life's path.......
Bankrutpcy is a BUSINESS DECISION to help those that NEED THE HELP......
It is a fresh start for those in financial distress....... societies way of helping them get back on their feet and survive.......
Soooooo, no tears, no whow is me, no feeling sorry for yourself.....
Buckle up, chin up, and make the business decision to help solve your financial problems and get your lives back on track.
We here are on the forum, have been there, done it...... we KNOW what you are going to experience and how you are going to feel.......
We will be there for you to advise, help answer questions if we can and for the moral support that you might need..... If you need to just "vent" - feel free too...... we hall have and do!!!
There is no "simple" bankrutpcy (how well I know), but most go very smoothly with no complications..... Some folks with higher incomes are forced to file Chapter 13 and pay back some of their creditors if financially able.

When its OVER, and its all behind you, you will wonder WHY YOU DIDN'T DO IT SOONER, INSTEAD OF STRUGGLING SO HARD............ I know I did - I fought filing bankruptcy for 4 years, working two jobs, ruining my health...... then finally a health issue forced me to file to clean it all up........
Your Ex thinks he left you in a big bind, file, and get that fresh start that you deserve......
You will be amazed at how quick its over, done with, and your on to a better (debt free) future...... getting rid of all the "baggage" from the past.....
We don't now what our futures hold in store for us, but we sure can make some business decisions to help straighten our lives out right now......

I am so glad I found this thread! My hubby and I are feeling the same way, embarrased, ashamed etc. We know it will be better for us personally and will allow us to better care for our family, but we live in a very small, close knit community where everyone knows everyone's business before days end! I don't want to say it's great to see so many others who have been through it, but it certainly makes a person feel not so isolated and alone in the world!

You should go look into getting some state aide. I'm sure you'll qualify if you don't make much. They might even have some sort of job training programs so that you can get a better job.
Your 17 year old could get a job at McDonalds and help contribute to the household. She's old enough to understand.
When I divorced, I got saddled with over $120,000 in divorce and student loan debt. I have been struggling too as you could imagine.
You're not alone. Keep strong!

Great post, Minnymouth. I agree totally. This society is not good to working people. I'm not going to get into politics, but just read the newspapers and see what big business gets away with. Look at the tax breaks they get and the way they behave. It costs me over $40 to fill my gas tank and the ceo of the gasoline company gets millions a year.
What seems like so much money to us is really just peanuts.
I never felt guilty about filing. I made some bad decisions but then I had health issues that made things worse. I just can't find it in myself to feel bad about taking whatever relief society offers me.
The one thing I was careful of was not doing anything I felt was wrong. I didn't charge anything after I made the decision to file. I had a chance to get a few hundred dollars back from one of my purchases and I chose to have it go back to the creditor because that felt right.
But I refuse to feel guilty about it and I refuse to destroy my health worrying about things.
Just look at it as a chance to start fresh and get some enjoyment out of life. You deserve it.
